Whistleblower Law: The False Claims Act

The False Claims Act (31 U.S.C. § 3729–3733) is a Federal law which allows private citizens to file lawsuits against companies claiming fraud against the government. The act of filing such actions is known as "whistleblowing." Recent cases involving Off Label Promotion by Pharmaceutical companies have yielded millions of dollars for Whistleblowers.

In fact Whistleblowers were paid $2.39 billion from 1987 to 2009, or 16 percent of the $15.19 billion collected in False Claims lawsuits in which the U.S. government joined the case, according to the Justice Department.

The False Claims Act provides a legal tool to counteract fraudulent billings turned in to the Federal Government. Claims under the law have been filed by people with insider knowledge of false claims which have typically involved health care, military, or other government spending programs.

IRS Whistleblower Rewards: The Tax Relief and Health Care Act of 2006

Although the False Claims Act covers many types of fraudulent activity against the federal government, it does not apply to tax fraud. The Tax Relief and Health Care Act of 2006 amended the Internal Revenue Code to provide financial rewards for individuals to report tax fraud just like the False Claims Act promotes the disclosure of fraud against the government by its contractors.

The law provides for very large whistleblower rewards: a whistleblower can expect to receive up to 30 percent of the total amount collected, including taxes, interest, and penalties.

Whistleblowers unhappy with the size of their rewards are permitted to challenge the amount in Federal Tax Court.  Additionally, the IRS is required to maintain a whistleblower office dedicated to the management of whistleblower claims. An IRS whistleblower no longer has to be a citizen of the United States. And finally, the IRS must keep the whistleblower's identity confidential.

The law is not aimed at small tax cheats but is aimed at companies  and individuals who have defrauded or cheated the IRS by more than $2 million, and whose annual income is at least $200,000.  With financial incentives and promises of confidentiality, Congress intended to encourage the employees of such individuals and corporations to step forward and put an end to the fraud.
